Tales of Timeless Heroes (ToTH)

1. Applicability

These terms and conditions apply to all offers, services, deliveries and agreements between Tales of Timeless Heroes (hereinafter 'ToTH') and its clients, regardless of whether they are private clients, companies (B2B) or educational institutions, unless otherwise agreed in writing. 

By placing an order or booking, the client agrees to these general terms and conditions.

2. Services

ToTH offers:

Customised Dungeons & Dragons sessions for individuals (private events, birthdays, one-shots), 

Teambuilding activities for companies (B2B),

Educational workshops and teaching packages for schools and teachers.

The concrete content, duration, location, price and target group will be determined in writing in advance.

3. Offers and Prices

All prices are stated in euros (€)

Offers are valid for 30 days, unless stated otherwise.

Travel costs are calculated based on the distance from Herent, unless agreed otherwise.

For customised work (companies, schools), a separate project price or hourly rate may apply.

4. Payment

Private individuals: payment at the latest 2 days before the session via bank transfer.

Companies/Schools (B2B): payment within 14 days after invoice date, unless agreed otherwise in writing.

If payment is not made, ToTH reserves the right to cancel or move the session

5. Cancellation and Modification

By Individuals:

Free cancellation up to 7 days before the session.

Cancellation 7-2 days in advance: 50% of the agreed price will be charged.

Cancellation within 48 hours: 100% will be charged.

By Companies/Schools (B2B):

Cancellation free of charge up to 14 days before the scheduled date.

Cancellation 14-7 days: 50% of the offer price.

Cancellation less than 7 days: full quotation price will be charged.

By ToTH:

ToTH reserves the right to cancel or reschedule a scheduled session due to force majeure, including (but not limited to) illness, accident, technical problems or other unforeseen circumstances that make execution of the session impossible.

In such a case, in consultation with the client, a new date will be set or any amounts already paid will be fully refunded.

No claim for any additional compensation of any kind, including but not limited to consequential damage, loss of profit or costs arising from the session not going ahead, can be made by ToTH in case of cancellation or rescheduling.

6. Liability

Participation in activities, services or sessions organised by ToTH is entirely at the own risk of the participant and/or client. ToTH does not accept any liability for direct or indirect damage, including but not limited to injury, material damage, consequential damage or immaterial damage, unless there is intent or gross negligence on the part of ToTH.

Adequate liability insurance covering any damage or injury that may occur during or as a result of the session; taking appropriate safety measures with due observance of all locally applicable laws and regulations; informing ToTH in advance of any risks or special circumstances at the location.

ToTH can never be held liable for damage arising from the absence or inadequacy of the insurance or safety measures to be taken by Principal.

7. Intellectual Property

All stories, scenarios, maps, miniatures and materials supplied or used by ToTH remain the property of ToTH.

They may not be copied, distributed or commercially used without written permission.

8. Privacy

Personal data will only be used for administrative purposes and will not be shared with third parties, except if required by law.

9. Specific to B2B & Education

Companies: The client is responsible for providing a suitable space, including sufficient tables, chairs and lighting.

Schools: Teachers participating in workshops or training courses receive material for educational use within their own school context only.

Schools and companies can optionally opt for an in-company training or workshop.

10. Disputes

All agreements are governed by Belgian law.

Disputes shall be submitted exclusively to the courts of Leuven.
